A 32-year-old Omaha man planned only to pick up a prescription and buy ice cream when he went to his local Walgreens in the Benson neighborhood.

Instead, Harry J. McCullough III shot a would-be-robber, 18-year-old Marquail Thomas, to death.

Douglas County Attorney Don Kleine said Tuesday afternoon that McCullough's use of deadly force was “appropriate and justified” and that he would not be charged in the slaying.

“There's no question that he had the right to defend himself and protect the lives of the others in the store,” Kleine said.

Nebraska law allows an individual to use force when his life or another person's life is threatened.

However, McCullough was ticketed by police for carrying a concealed weapon, a misdemeanor.

He had a permit to carry a loaded handgun in plain view for example, in a holster but he did not have a concealed weapons permit, said Omaha Police Officer Jacob Bettin.

McCullough pulled his handgun from the waistband of his pants before he shot Thomas, authorities said.

Kleine said civilians normally shouldn't put their lives at risk to prevent a crime. However, “if someone feels threatened,” he said, “they have the right to defend themselves.”

No one else in the store was injured.

Mark Bohaty, a firearms instructor in Bruno, Neb., said he didn't know the details of what happened in the Walgreens store.

Bohaty said he teaches students that using lethal force cannot be a gun carrier's first option when threatened.

“It is truly a last-resort type of thing,” he said. “The threat needs to be real, immediate, and they must be convinced that if they don't use deadly force, they are going to suffer critical injury or death as a result of the threat against them” or against a family member or a stranger.

Bohaty said people must use their judgment on whether lethal force is appropriate.

“There's no pat answer,” he said.

Police said two masked men entered the Walgreens at 6101 Northwest Radial shortly before 9 p.m. Monday.

McCullough declined a request for an interview when contacted by The World-Herald o Wednesday.

He had just made his purchase and was placing his credit card back into his wallet, said his lawyer, James Martin Davis.

One of the robbers, identified as Thomas, pointed a short shotgun in the direction of the cash register, where several customers were standing in line and told them not to move.

Davis said his client was armed with a .40-caliber pistol and fired after Thomas put the shotgun against the back of a woman using the ATM near the store entrance.

Davis said McCullough described Thomas' weapon as a Remington 870 sawed-off shotgun that holds five rounds. Kleine said the shotgun was not loaded.

Thomas dropped the shotgun and fled from the store, but he collapsed outside.

The second man, 17-year-old Angelo Douglas, scurried to the back of the store. McCullough chased him down, dragged him to the front of the store at gunpoint and held him until police arrived, Davis said.

Police were still looking for a getaway driver.

Robert Elfinger, a spokesman for Walgreens, said the store is cooperating with police and declined to comment further. The store reopened at 8 a.m. Tuesday.

Davis said McCullough has held several security jobs, which was why he frequently carries his weapon.

McCullough worked in security at the College of Saint Mary from April to October in 2008, a human resources employee at the college said. He currently is employed by the Nebraska Medical Center, Davis said, but not as a security officer.

McCullough was convicted of carrying a concealed weapon in 1997. Davis said that case involved a knife. He was convicted of driving under the influence in Washington County in 2006.

Douglas was charged Wednesday with attempted robbery, conspiracy to commit robbery and weapon use.

If convicted, Douglas would face up to 120 years in prison — 20 years on the attempted robbery, and 50 each on the conspiracy and weapons charges.

Kleine said he charged Douglas with the weapons count because, authorities allege, he took part in a crime in which a gun was used. He is being held at the Douglas County Youth Center.

Douglas has no serious criminal record, other than misdemeanor charges of disorderly conduct and obstruction of law. Those charges were transferred to juvenile court in March.

Thomas was convicted earlier this month in Douglas County Court of obstructing the law and served three days in jail. He also was convicted of possessing an ounce or less of marijuana in Douglas County in December.

It was almost exactly a year ago April 29, 2009 that Thomas was shot when two males approached a crowd near 21st and Evans Street and opened fire.

He's definitely a different breed kinda dude and I'm very interested to see how in-depth they go with his personal life and his time away from football. These 30 for 30 documentaries have been some of the best TV I've seen in a long time. Ricky is a different type of dude. He's always been that way. Jordan's aside, Air Max 90's are probably my favorite sneaker. With that said the Infrared is simply the cleanest and unique colorway I have seen on this shoe. I was lucky enough to get these when they re-released in 06 for $80. This of course was prior to the hype that drove these kicks to prices of $300+ online. It seems like the only time Just Blaze isn't in the sky these days is when he's working. Blaze has been DJing at places like the Winter Music Conference when he isn't busy traveling back and forth and producing for people such as Jay Electronica and Eminem.

"I'm working on Eminem's album still, so I've gotta hurry up and get back to Detroit," Just said. He was fresh off the turntables at club Grand Central during the Fool's Gold party in Miami, where he spun a two-hour house set. "I've been back and forth — Detroit, New York, Detroit, New York, Miami, back to Detroit — for like the past two and a half weeks. [The album], it's getting there, but we still got a lot of work. So I wish I could stay [in Miami] longer."
Blaze says he's sworn not to reveal too much about Eminem's album, but he's already calling it a classic, one of the ultimate efforts in Slim Shady's storied catalog.

"As far as what's going on in Detroit, a lot of good music is being made," Blaze said of Em. "He's really back spitting. The wordplay is crazy, the metaphors are crazy. He's really back on his game. He had his ups, he had his downs, he's back way, way, way up. This is definitely going to be up there with the best of his albums, for sure, for sure. The fact that he's branched out working with a lot of different people now, collaborating in a lot of different ways that he never has before, I think he's going to surprise a lot of people."

Other than Em, Blaze has Jay Electronica on his plate, but what about the super-producer linking back with the other Jay, as in Young Hova? Just says he talked to the Jiggaman right before the U.S. leg of the Blueprint 3 tour ended.

The last meal is a customary part of a condemned prisoner's last day. The day before the appointed time of execution, the prisoner will be given the meal, as well as religious rights, if he or she desires. As a general rule, inmates may not ask for an alcoholic drink as it dulls the senses.

In many countries the prisoner may have the luxury of selecting what the last meal will be (within reason), and the authorities do their best to provide a prisoner with the requested meal. This would honestly be a long decision for me. I am pretty sure that I would include a Chipotle burrito in my meal. I stumbled upon this yesterday and here's a list of them:

Nas went to court Monday over his divorce with Kelis -- and walked out a little lighter in the wallet.

According to documents filed in L.A. County Superior Court, Nas had to immediately fork over $47,249.42 in back child support and $40,454 in back spousal support.

The judge also ordered Nas to pay $10,000/month in spousal support until he pays off the $299,015.50 he owes Kelis.

Nas also has to pay 90% of Kelis' legal fees in the amount of $155,787.28.

Lastly, Nas has to pay $48,549.83 to cover Kelis' accounting expenses.

Receiver Santonio Holmes, who was traded to the New York Jets on Sunday from the Pittsburgh Steelers, will be suspended for the first four games of the 2010 season for violating the NFL's substance abuse policy, a source confirmed to ESPN NFL Insider Adam Schefter.

The Jets acquired the talented but troubled receiver from the Steelers for a fifth-round pick in this month's draft. ESPN 1050 in New York first reported the trade, which Jets owner Woody Johnson publicly confirmed on Monday at the team's camp in Cortland, N.Y.

"He's known by members of the team," Johnson said. "Everybody has a lot of respect for him. He's tough. He's a clutch receiver. I don't think pressure gets to him in a game. We were happy to start this [relationship]."

Holmes is heading to New York Monday morning to take a physical, sources told ESPN. He will then will meet with Jets officials before the trade is officially announced.

No news conference is expected on Monday.

The Pittsburgh Post-Gazette reported on Monday that according to sources, the Steelers were prepared to release Holmes had they not been able to trade him.

Holmes will have to wait to get on the field. On Saturday, ProFootballTalk.com first reported Holmes was facing a suspension. The Web site reported it was unknown whether Holmes tested positive for a prohibited substance or committed some other violation of the policy, such as missing a required test, and that the Holmes' appeal process had not been finalized.

Schefter's source told him on Monday that although the four-game suspension has not officially been announced by the NFL, it has been finalized.

Holmes, the 2009 Super Bowl MVP, gives second-year quarterback Mark Sanchez another big-time target to throw to in an offense that already included receivers Braylon Edwards, Jerricho Cotchery, promising tight end Dustin Keller and recently signed running back LaDainian Tomlinson.

In a down-to-the-wire loss to the Portland TrailBlazers, Kobe Bryant and a few of his teammates wore NikeiD contest winner Kid Hollywood’s fantastic Kobe V design. Sticking with the Lakers alternate jersey color scheme, Hollywood applied a primarily white-colored base with minimal yellow and purple hints on the base. Hip-Hop pioneer DJ Premier recently weighed in on Kanye West's upcoming Good A** Job album and called the rapper's solo project "hard beats and rhyme."

Based off a recent interview, Premo also credits Yeezy for bringing back the popularity of sampling old records.

"Well, first of all, if you look at all of Kanye West's output, he actually did a lot to bring back sampling and make it cool again, even though he's more of a mainstream artist" Premier explained. "But his new album is strictly hard beats and rhyme. He's totally done with electro. You're gonna be surprised what you hear." (Amajanese)

Rap veteran Q-Tip also revealed his involvement on West's album.

"I just try to work with people who I admire or whom I think has got it," he revealed in an interview. "So right now I'm working on Nas' sh*t, about to work with Kanye on his sh*t. Just trying to keep up my momentum. I'm about to work with Talib [Kweli] on his project. According to new reports, the follow-up to 2008's 808's & Heartbreak is coming out in June.

Kanye West is ensconced in his Diamond Head, Hawaii home and recording studio, putting the final touches on his forthcoming album with guest rappers like Q-Tip, RZA and Pete Rock, numerous reports have confirmed. A source close to the project -- which is tentatively titled "Good A** Job" according to G.O.O.D. Music artist Big Sean -- says it will be released in June. (Billboard)
